Introduction

Welcome to THInsurances. These Terms and Conditions govern your use of our auto insurance services and your relationship with THInsurances as a policyholder or prospective customer. By purchasing a policy or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety.

These terms constitute a legally binding agreement between you and THInsurances. If you do not agree with any part of these terms, you should not purchase or continue to use our insurance products or services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting to our website.

Acceptance of Terms

By submitting an application for auto insurance coverage with THInsurances, whether online, by phone, or through an authorized agent, you explicitly agree to these Terms and Conditions. Your continued use of our services, payment of premiums, or filing of claims constitutes ongoing acceptance of these terms and any subsequent modifications.

You represent and warrant that all information provided in your insurance application is accurate, complete, and truthful. Any misrepresentation or omission of material facts may result in denial of coverage, cancellation of your policy, or denial of claims. You have an ongoing duty to update THInsurances with any changes to your personal information, vehicle details, or circumstances that may affect your coverage.

Policy Coverage

Your auto insurance policy with THInsurances provides coverage as specifically outlined in your policy documents, including your declarations page, endorsements, and the terms set forth in the policy itself. Coverage types may include liability coverage, collision coverage, comprehensive coverage, uninsured motorist protection, personal injury protection, and any additional coverages you have elected to purchase.

Coverage is subject to the limits, deductibles, exclusions, and conditions specified in your policy. Not all damages, losses, or circumstances are covered under your policy. It is your responsibility to review your policy documents carefully and understand what is and is not covered. Coverage begins on the effective date specified in your policy and continues through the expiration date, provided all premiums are paid when due.

Certain activities, uses of your vehicle, or circumstances may void coverage or result in exclusion from coverage. This includes but is not limited to use of your vehicle for commercial purposes without appropriate commercial coverage, racing, intentional acts, driving under the influence of alcohol or drugs, or operation of your vehicle by an excluded driver.

User Responsibilities

As a policyholder, you have certain responsibilities to maintain your coverage and ensure the validity of your policy. You must maintain a valid driver's license and comply with all applicable traffic laws and regulations. You are required to notify THInsurances promptly of any changes to your address, vehicle ownership, additional drivers in your household, or other material changes that may affect your coverage or premium.

You must take reasonable precautions to prevent accidents, injuries, and property damage. This includes maintaining your vehicle in safe operating condition, securing your vehicle when unattended, and ensuring that anyone operating your vehicle is properly licensed and authorized. Failure to take reasonable precautions may affect coverage in the event of a claim.

You are responsible for reviewing your policy documents upon receipt and notifying THInsurances immediately of any errors or discrepancies. You must cooperate fully with THInsurances in the investigation of any claims, including providing documentation, testimony, and access to your vehicle as requested. You agree not to make any statements or admissions of liability at the scene of an accident without first consulting with THInsurances.

Payment Terms

Premium payment is a condition of coverage. Your initial premium payment is due upon binding of coverage, and subsequent premium payments are due according to the payment schedule specified in your policy. THInsurances offers various payment options including annual, semi-annual, quarterly, and monthly payment plans, subject to any applicable installment fees.

If you choose to pay your premium by automatic payment method, you authorize THInsurances to electronically debit your designated bank account or charge your designated credit card for the premium amounts when due. It is your responsibility to ensure sufficient funds are available in your account to cover premium payments. Returned payments may result in a service charge and could lead to policy cancellation.

Failure to pay premiums when due may result in cancellation of your policy. In the event of cancellation for non-payment, you will be notified as required by law. Upon cancellation, any unearned premium may be refunded according to the terms of your policy and applicable state regulations. Reinstatement of a cancelled policy is at the sole discretion of THInsurances and may require payment of all past due premiums plus any applicable fees.

Claims Process

In the event of an accident, loss, or incident that may result in a claim under your policy, you must notify THInsurances as soon as reasonably possible. Claims can be reported through our online portal, by telephone to our claims hotline, or through your insurance agent. When reporting a claim, you should provide all relevant information including the date, time, and location of the incident, names and contact information of all parties involved, witness information, and any available police report information.

You are required to cooperate fully with THInsurances throughout the claims investigation and resolution process. This includes providing access to your vehicle for inspection, submitting to examination under oath if requested, providing documentation such as medical records or repair estimates, and responding promptly to communications from claims adjusters. Your cooperation is a condition of coverage, and failure to cooperate may result in denial of your claim.

THInsurances reserves the right to investigate all claims thoroughly to determine coverage and liability. We may conduct interviews, examine evidence, consult with experts, and take any other actions necessary to investigate your claim. Claims will be paid according to the terms of your policy, subject to applicable deductibles, limits, and exclusions. Payment of a claim does not constitute an admission of liability or waiver of any rights or defenses available to THInsurances.

Cancellation Policy

Either you or THInsurances may cancel your policy subject to the terms and conditions outlined in your policy documents and as required by applicable state law. You may cancel your policy at any time by providing written notice to THInsurances. Upon cancellation by you, you may be entitled to a refund of unearned premium, calculated on a pro-rata basis minus any applicable fees or outstanding amounts owed.

THInsurances may cancel your policy for reasons permitted by law, including but not limited to non-payment of premium, material misrepresentation or fraud in your application or claim, substantial increase in risk, loss of your driver's license, or other reasons as specified in your policy. In the event of cancellation by THInsurances, you will receive advance written notice as required by law, and any unearned premium will be refunded according to applicable regulations.

Upon cancellation or expiration of your policy, coverage ceases immediately. You are responsible for obtaining new insurance coverage to avoid any lapse in coverage. A lapse in insurance coverage may result in higher premiums, penalties, or legal consequences depending on your state's requirements for mandatory insurance coverage.

Limitation of Liability

THInsurances's liability under your policy is limited to the coverage limits, terms, conditions, and exclusions set forth in your policy documents. In no event shall THInsurances be liable for any amount exceeding the applicable policy limits you have purchased. Our liability is further limited to those losses or damages that are directly caused by a covered event as defined in your policy.

THInsurances shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your policy or our services, including but not limited to loss of use of your vehicle, loss of income, emotional distress, or diminution in value of your vehicle. Our liability is strictly limited to the direct damages covered under the specific terms of your policy.

THInsurances makes no warranties or representations regarding our services beyond those explicitly stated in your policy documents. We do not guarantee that our services will be uninterrupted, error-free, or meet all of your expectations. We are not responsible for the actions or omissions of third parties, including repair shops, medical providers, or other service providers that you may engage in connection with a claim.

Changes to Terms

THInsurances reserves the right to modify, amend, or update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or as otherwise communicated to you. Your continued use of our services or payment of premiums following any such changes constitutes your acceptance of the modified terms.

Material changes to these Terms and Conditions will be communicated to you through written notice, email, or posting on our website. It is your responsibility to review these terms periodically for any updates. If you do not agree with any modifications to these terms, your sole remedy is to cancel your policy in accordance with the cancellation provisions outlined in your policy documents.

Changes to your specific policy terms and coverage require a policy amendment or endorsement. Policy amendments will be provided to you in writing and will specify the effective date of any changes to your coverage, limits, deductibles, or premiums. You will have the opportunity to accept or reject material changes to your policy coverage.
